Georgia Statute of Limitations

In Georgia, the statute of limitations is not the same for all types of cases. Georgia has a two year statute of limitations running from the date of injury or death, and a five-year statute of “ultimate repose and abrogation”.

Georgia doesn’t limit the amount of compensatory damages that may be awarded. Punitive damages are capped at $250,000, unless it can be demonstrated that the defendant had an intent to harm. Ga. Code Ann. § 51-12-5.1 (1992).
